General Terms and Conditions (GTC) — GlobaTrustInvestment & BungalowParksEurope
Damages and Remedies We reserve the right to claim damages for breaches of contractual license conditions, notably copyright violations.
Scope and Application These GTC apply to coaching bookings and all business relations between the coachee and GlobaTrustInvestment. Special conditions that deviate from these GTC may be agreed upon when an order is placed. Silence or lack of objection does not imply acceptance of the coachee’s terms.
Confidentiality and Data Processing GlobaTrustInvestment keeps customer‑related facts and assessments confidential and shares information only with customer consent. We record and process coachee data in accordance with the Federal Data Protection Act (BDSG). The coachee consents to automatic storage and processing of personal data within our IT systems.
Liability of GlobaTrustInvestment and Coachee’s Duty of Care 3.1 The content, strategies, and recommendations from coaching do not relieve the coachee of their duty of care. The coachee uses the information independently and at their own risk. 3.2 GlobaTrustInvestment is liable for damages only within the limits of statutory law and the provisions below. 3.3 Claims for damages and reimbursement of expenses by the coachee are excluded, regardless of legal basis. 3.4 Exceptions to this exclusion apply: a) Liability under the Product Liability Act; b) Cases of intent or gross negligence; c) Culpable injury to life, body, or health; d) Breach of essential contractual obligations (those whose fulfillment is necessary for proper contract execution and on which the coachee regularly relies). Liability for breach of essential obligations is limited to foreseeable, contract‑typical damage unless intent or gross negligence applies, or injury to life, body, or health occurs. 3.5 The above exclusions or limitations of liability also apply to employees, vicarious agents, and legal representatives of GlobaTrustInvestment. 3.6 The burden of proof does not shift to the detriment of the coachee due to the above rules. 3.7 The regular limitation period for claims is shortened to two years from the start of the statutory limitation period. This does not apply to claims for damages referred to in Section 3.4 a), b), and c).
Offsetting Claims The coachee may offset claims against GlobaTrustInvestment only if those claims are undisputed or legally established.
Governing Law and Jurisdiction German law applies to the contractual relationship. Place of performance and jurisdiction, to the extent permissible, is Nuremberg.
Registration and Offer Changes Our online offers do not constitute an obligation to accept bookings. We reserve the right to change service content at any time. All offers (information, strategies, lists, books, etc.) are subject to change.
Execution of Appointments Appointments are held as agreed, generally in person. We reserve the right to change the program, including venue, date, time, and content.
Severability Clause If individual provisions of these terms become invalid, the remaining provisions remain in force. Invalid provisions will be replaced by agreements that match the economic purpose as closely as possible.
Independent Action and Risk Disclaimer We provide services and tools for your use. You must determine the information you need for any trading decision.
